Director of Risk Management
The Risk Management Director-Associate General Counsel is responsible for enterprise-wide mitigation of loss. The Risk Management Director-Associate General Counsel will supervise the investigation of all patient harm events, will coordinate RCA process and assignment of related corrective action plans. Conducts literature searches to identify best practices and comparative benchmarks for hospital operation/quality/safety measures. Risk project manager of the system-wide occurrence reporting and analysis process, and is responsible for patient harm event analysis and development of associated risk reduction action plans for unexpected adverse patient-related events.
Analyzing hospital arrangements to minimize risk and ensure compliance with all applicable federal, state and local laws and regulations.
Primary responsibility and expertise in two or more areas of law directly relevant to the operations of health system, including but not limited to, regulatory/compliance, complex health system transactions (clinical research, practice/asset purchase agreements), managed care, hospital/healthcare/physician contracting, medical staff and credentialing, and physician relations.
Legal guidance, document preparation, and strategic support for both Management and the Board of Trustees related to the design, development and implementation of systems and projects focusing on regulatory and compliance and other areas of expertise identified herein
Provide in-depth analysis and application of the federal Anti-Kickback law and Stark law, HIPAA, PPACA, EMTALA, Centers for Medicare and Medicaid Services (CMS) Conditions of Participation, and Medicare and Medicaid regulations regarding billing and reimbursement and apply knowledge of federal and state statutes and regulations to proposed arrangements and relationships and effectively communicate regulatory issues to the Board of Trustees, Management and personnel.
Provide exceptional legal guidance in an effort to assure that actions proposed by Management and the Board are consistent with sound legal theory and practice, compatible with the Hospital Authority Act, in accord with Board policy, not in violation of any local, state, or federal law, defensible, and congruous with acting for the public good.
Work under the guidance of and will assist the Chief Legal Officer in protecting Health System and its affiliates against legal risk and assuring compliance with all applicable laws, regulations and orders of courts of competent jurisdiction.
Department Position Summary:
Provide advice and counsel to Management and the Board as needed, primarily focusing on issues related to an area of primary responsibility for the health system and its affiliates.
Provide advice and counsel to Management and the Board on legal and regulatory matters.
Design, develop and direct the implementation of legal policies and projects for the health system and its affiliates, including but not limited to developing template agreements and designing cross-functional processes to improve efficiency.
Provide counsel for, and direct projects relating to, the health system and its affiliates, including but not limited to conducting legal and risk analysis, managing correspondence, coordinating the use of internal and external resources and personnel, and supervising negotiations.
Provide education to Management and the Board on legal issues as needed.
Manage and work with outside counsel in areas as assigned by Chief Legal Officer.
Maintain expertise in legal principles of healthcare organizations, including anti-kickback and self-referral laws and regulations, EMTALA, HIPAA, PPACA laws related to physician engagement, and requirements of federal and state health programs.
Pursue continuing legal education and professional development opportunities that will build upon existing healthcare law expertise, promote the development of new spheres of knowledge and provide added value for the health system and its affiliates.
Assist Chief Legal Officer in supporting the Board.
Strive to improve internal legal systems and processes.
Follow procedures to assure compliance with Authority policies.
Assist the Chief Legal Officer in providing effective and efficient organization of the legal function for the health system and its affiliates, with a strong emphasis on quality results (output) and expense control/reduction (operational, claim defense and claim awards).
Draft legal opinions when requested that identify options to accomplish health system goals while maintaining compliance with applicable legal requirements.
Experienced legal specialist with primary responsibility and expertise in two or more areas of law directly relevant to the operations of hospital, including but not limited to, regulatory/compliance, complex health system transactions (clinical research, practice/asset purchase agreements), managed care, hospital/healthcare/physician contracting, medical staff and credentialing, and physician relations.
Provide legal guidance, document preparation, and strategic support for both Management and the Board of Trustees related to the design, development and implementation of systems and projects focusing on regulatory and compliance and other areas of expertise.
Required: Graduate from an accredited law school with a LL.B or J.D. Degree. High academic achievement with participation in law review and/or moot court is highly desirable.
Required: Three (3)+ years relevant legal experience.
Preferred: Experience (in-house and/or Big Firm) in providing sophisticated legal representation to not-for-profit corporations and healthcare providers is highly desirable. Malpractice, Risk and/or Provider experience. Professional Liability, litigation experience.
